This Privacy Policy explains the online information practices of SnapCyte Solutions Inc. (collectively, “Company,” “SnapCyte,” “SnapCyte Solutions Inc.,” “we,” “us,” or “our”) which collects, uses, and shares information collected from users of our mobile application and website (collectively, the “Services,” “SnapCyte™ App,“ “Application,“ “App,“ “SnapCyte™ Adapter,“ or “Adapter“).

At Snapcyte, we highly value the privacy of our users (“User,” “You,” or “Your”) and acknowledge the sensitivity of your personal information. We are dedicated to protecting your personal information and using it only as necessary to offer you the best service, products, and prospects, or as otherwise explained in this Privacy Policy. 

We think it is essential to clarify to our users what personal information we collect, how we use it, and what rights they have with respect to their processed data. We are committed to complying with all applicable data protection laws and regulations and serve as the data controller responsible for adhering to any relevant local legislation.

Please note that when using the Services, this Privacy Policy should be read in conjunction with our Terms of Use. By registering and accessing the Application, you acknowledge that the Privacy Policy and the Terms of Use govern your use of the Application and our website. If you do not agree to the terms set out in this Privacy Policy, we request that you cease using any of our Services immediately.

1. What Information We Collect

In order to conduct our business efficiently, we may need to gather and store personal information about you. This may include (but is not limited to) information necessary to provide services or information, enhance our offerings to provide a superior experience, and meet regulatory requirements. To achieve these objectives, we may collect the following personal information from our users:

Personal Information: We may collect personal information, including (but not limited to) your name, email address, phone number, shipping and billing information when you register for an account on our website, contact customer support, purchase a subscription, or otherwise submit information in the course of using the Services.

Usage Information: We may collect information about your use of the Services, including (but not limited to) the images you upload and the analytics generated by our artificial intelligence (AI) model.

Device Information: We may collect information about the devices you use to access the Services, such as your mobile device type and operating system.

Log Data: We may automatically collect log data, which may include your IP address, information regarding the physical location of your device, browser type, and the date and time of your access.

Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyze our Service.

Cookies: Cookies are small files which, when placed on your device, enable the Platform to provide certain features and functionalities. We and our service providers use cookies to automatically collect information, measure and analyze which pages you click on and how you use the application, enhance your experience using the application, and improve our services. Cookies may include information such as your login or registration identification, user preferences, time spent on a website and pages visited.
Examples of Cookies we use: (i) Session Cookies (used to operate the Services); (ii) Preference Cookies (used to remember your preferences and various settings); (iii) Security Cookies (used for security purposes); and (iv) Advertising Cookies (used to serve you with advertisements that may be relevant to you and your interests). We may also use third-party tracking technology to record similar information regarding you and your activity on the Application. 

By using the Application, you consent to our use of Cookies. You can change your cookie preferences by clicking on the cookie management tool implemented on our Website, or by instructing your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept the use of cookies, you may not be able to use some portions of our Services. 2. How Information is Used

We use the information we collect for the following purposes:

(a) To provide and maintain the Services;

(b)To communicate with you about the Services, including sending you updates, notifications, news, updates regarding your account,  special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about, unless you have opted not to receive such information;

(c) To verify your identity and screen for potential risk of fraud;

(d) To provide customer support and respond to your enquiries;

(e) To analyze and improve our Services;

(f) To protect our rights and the rights of other users;

(g) To comply with legal and regulatory obligations; and

(h) For any other purpose with your consent.

We will not use or disclose your Personal Information to any party except as described in this Privacy Policy. We will not sell your Personal Information to other parties without your consent (excepting in the case of a merger, acquisition, or other corporate transaction). Except as explicitly specified herein, we will obtain your express or implied consent to collect, use, sell or disclose any Personal Information. You can provide consent orally, in writing, electronically or through an authorized representative. You provide us with implied consent where our purpose for collecting, using or disclosing Personal Information is necessary for the provision of our Services or would be considered obvious or reasonable in the circumstances. Your consent may also be implied where you have received notice and a reasonable opportunity to opt-out of having the Personal Information used, and you have not provided us with notice of opting-out.

We may collect, use or disclose your Personal Information without your consent in the following circumstances:

(a) when permitted or required by law;

(b) in an emergency that threatens an individual’s life, health, or personal security;

(c) when the Personal Information is available from a public source;

(d) when we require legal advice from a lawyer; 

(e) the purposes of collecting a debt or protection from fraud;

(f) or other legally established reasons.

3. Data Retention

We retain your personal information for as long as it is necessary and relevant for our business. The criteria used to determine the retention periods include: (i) how long the personal information is needed to provide the services and operate the business; (ii) the type of personal information collected; and (iii) whether we are subject to a legal, contractual or similar obligation to retain the personal information (e.g., mandatory data retention laws, government orders to preserve data relevant to an investigation, or data that must be retained for the purposes of litigation or disputes). We make no guarantee of any period of retention and reserve the right to delete such information at any time. We will use appropriate security measures when destroying your Personal Information such as shredding documents or deleting electronically stored information.

Please note, when you purchase any product or service through the Website, submit our contact form, or enroll in our mailing list, we will indefinitely maintain your name and email for our records unless and until you request that we delete this information.

4. Data Rights

You possess specific rights (subject to certain limitations) with regards to your personal information, including (i) the ability to request access to your personal information held by us (including information on where it is being stored and the purpose for storing it); (ii) the right to have any incorrect, outdated, or incomplete personal information corrected; (iii) the right to request that we delete your personal information; (iv) the right to opt-out of any marketing communications that we may send to you and to object to us using or retaining your personal information if we have no legitimate reason to do so; (v) the right to portability of personal information i.e., to request a copy of your personal information in a digital format to be provided to you or a third party. In instances where we rely on your consent to process your personal information, you possess the right to withdraw such consent at any time. It is important to note that we do not sell personal information to third parties for their own business or commercial purposes.

Kindly note that if you request the deletion of your personal information, you may no longer have access to certain parts of our Services. We will provide a written or oral response to your request as soon as practical and may request identification proof to verify your request.

You can learn more about your legal rights at: Office of the Information and Privacy Commissioner for British Columbia (the “OIPCBC”). Additionally, you reserve the right to lodge a complaint about the handling of your personal information with the OIPCBC, an EU data protection authority or other relevant regulator. If you are a California, USA resident, you may request specific information about our disclosure of personal data to third parties for their direct marketing purposes during the previous calendar year, as more particularly set out below. We confirm that we do not share your personal data with third parties or corporate affiliates for their direct marketing purposes.

5. Data Storage and Security

Your Personal Information may be stored electronically in our database, including databases hosted by applicable third-party Service Providers, as defined below, or in hardcopy format. We maintain cyber security standards and procedures designed to prevent unauthorized access to your data by anyone, including our staff. We use commercially reasonable means such as (but not limited to) data encryption, firewalls and server authentication to protect the security of your personal information. However, no information security defenses are impenetrable, and we cannot guarantee the security of our applications, servers or databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet. Accordingly, We make no guarantee as to the absolute security of the Personal Information.

In the unlikely event that our system is breached, and any Personal Information has been compromised, we will notify such local authorities as may be required within seventy-two (72) hours of the breach, and will also use our best efforts to notify you, using the most current contact information that we have on file. We are not responsible for any failure to notify you based on incorrect or outdated contact information.

6. Third Party Service Providers

From time to time, we may make use of third-party service providers (“Service Providers”), including service providers located in Canada and the United States to store and process data, including your Personal Information, on our behalf. When acting on our behalf, such service providers shall only be authorized to collect, use, disclose or store your Personal Information in accordance with this Privacy Policy. However, the government, courts, law enforcement, security, or regulatory agencies of a particular country may be able to obtain access to or disclosure of Personal Information as permitted by the laws of that country. A current list of third-party service providers who may have access to your personal information is as follows:

Amazon Web Services we use Amazon Web Services to host data for us to facilitate the provision of our Services. Additional information on how Amazon Web Services processes personal information is available here.

Stripe – we use the Stripe third-party payment processing service to collect payments from our uses. Stripe may collect certain personal payment information to collect payment. Stripe’s Privacy Policy can be viewed here.

Google Analytics – we use Google Analytics to help us understand how our customers use the Services. Google Analytics may collect your IP address, data related to the device/browser, or other information about your use of the Application and may do so using cookies.  Google Analytics’ data practices are governed by the Google Privacy Policy, as it may be amended from time to time.

7. Behavioral Advertising

As set out above, we may, from time to time, use your Personal Information to provide you with targeted product and marketing information that we believe may be of benefit to you, using such third-party service providers as Google AdWords, LinkedIn Ads, and ResearchGate Ads.

8. International Audience

The Application is hosted in the United States. Therefore, personal information collected from you, including via the Services, will be transferred to the United States. Such transfer may not provide a similar level of protection to that provided by countries in foreign jurisdictions. As discussed above, we have a legitimate interest in utilizing service providers in the United States to provide you with the services. We will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Please do not use the Application if you do not agree to the transfer and processing of your personal information in the United States or if it is illegal to do so in your home country. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to such transfer.

9. Citizens of the European Union

If you are a European resident, please note that we are located in Canada and your Personal Information may be processed in any country where we engage service providers, including the United States of America. If you are located in the European Economic Area (“EEA”), we comply with the provisions of the General Data Protection Regulations that protect your Personal Information. As set out above under section 4, you have the right to: (i) access, update or delete your personal information; (ii) rectify any inaccurate or incomplete information; (iii) object to the processing of your personal information; (iv) restrict the processing of your personal information; (v) the right to data portability; and (vi) the right to withdraw consent to process your Personal Information. Where we transfer your data to third parties outside of the EEA, we will ensure that certain safeguards are in place to ensure a similar degree of security for your Personal Information. As such:

(a) we may transfer your Personal Information to countries that the European Commission has approved as providing an adequate level of protection for Personal Information; or

(b) where we use certain service providers who are established outside of the EEA, we may use specific contracts or codes of conduct or certification mechanisms approved by the European Commission which give personal data the same protection it has in the EEA.

If none of the above safeguards is available, we shall only transfer your data where you have provided your consent. You will have the right to withdraw this consent at any time.

10. Rights Under the California Consumer Privacy Act (“CCPA”)

If you are a resident of California, you may request that we disclose to you, free of charge (unless your requests are manifestly unfounded or excessive) the following information in relation to your Personal Information that we have collected, disclosed or sold in the preceding twelve (12) months: (i) the categories and specific pieces of your Personal Information collected; (ii) the categories of sources from which such Personal Information was collected; (iii) the business or commercial purpose for collecting, disclosing or selling such Personal Information; and (iv) the categories of third parties with whom we share such Personal Information.

To exercise the rights set out above, you must provide a verifiable consumer request and personal identification records by either emailing us at contact@snapcyte.com or by writing to our Privacy Compliance Officer at the address set under section 15.

We do not sell your personal information for monetary consideration. However, under some circumstances, a transfer of Personal Information to a third party, or an affiliated company, without monetary consideration may be considered a “sale” under California law. If you submit a request to stop selling your personal information, we will stop making such transfers. If you are a California resident, to opt-out of the sale of your personal information, please send us a request titled “Do Not Sell My Personal Information”. Please note, if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain Services, which require the usage of your personal information to function. But under no circumstances will we unduly restrict your access or rights, other than as strictly necessary, on the basis of such requests.

11. Links to Third Party Websites

Our Services may contain links to other websites that we do not control (“Third Party Sites”). Privacy and personal data protection principles vary from one country to another. We strongly advise you to review the privacy policy of every site you visit to determine the privacy practices that apply to information or data maintained by such a website or application within such jurisdiction. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any Third Party Site or their associated services.  

12. Children’s Privacy

Our services are not intended for use by children under the age of majority. We do not knowingly collect personal information from minors. If you are a parent or guardian and you are aware that your minor child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from minors, we will take all appropriate steps to remove that information from our servers.

13. Do Not Track

Please note that we do not alter our data collection and use practices when we receive any type of Do Not Track signal from your browser and will continue to collect, use, and dispose of your Personal Information in accordance with this Privacy Policy.

14. Changes

We may update this Privacy Policy from time to time. If we make material changes to this Policy, we will notify you by email or by posting a notice on our website. Changes are effective as of their posting on this webpage. You are advised to periodically review our Services after changes are made to this Privacy Policy, you are agreeing to be bound by the updated Privacy Policy. If you do not agree to be bound by the updated Privacy Policy, please stop using our Services.
